Please keep your posts and replies polite. My older sister has a grandchild who is almost 2 years old. The child was born in Cebu and is still here. The child's mother is my sister's daughter, a U.S. citizen, and the father is an American who has lost contact with them. The child has a U.S. passport. What my sister wants is for the child to have dual citizenship, but when she talked to immigration officers in Manila and Cebu, they said it isn't possible and that she has to pay the child's immigration fees every few months. Does anyone know a way this child could get dual citizenship?
Call the US Embassy and give them the American father's name and information. They will guide you properly. As long as it's proven, the child is eligible for US citizenship.
I'm not sure, but I would apply for a Philippine passport for the child. If they issue it, the problem goes away.
An important piece of information is missing. Is your niece 1) Filipino or 2) American? If she is Filipino and was a Filipino citizen when the child was born, the child is already a dual citizen from birth. Get the child a Philippine passport. There is a passport application fee, but no ongoing immigration fees. If both parents are American and neither was a Filipino citizen when the child was born, the child is a US citizen and not a Philippine citizen. The Philippines has no birthright citizenship, so the child is subject to Philippine immigration requirements and the applicable visa fees.
If the child was born in Cebu, the child is a Filipino citizen. Take the PSA copy of the birth certificate to the DFA and get a Philippine passport. Don't go to the BI.
